Do you have a Will or other estate plan in place? Do you have a Durable Power of Attorney and a Medical Power of Attorney? Have you executed a Living Will? Do you know what these documents are? Do you have minor children? What will happen to them if you die unexpectedly? Did you know you can nominate someone to become their guardian? Did you know you can nominate the person to manage the money for them, and that it doesn’t have to be the same person?
What about incapacity? As we live longer and longer, more of us are living out our last years in a condition where we are not capable of managing our own affairs anymore. Do you know a Power of Attorney won’t help in that situation? What happens if you need to qualify for public assistance in order to pay for the care you need? Who will take care of your affairs if you become disabled or incapacitated? Have you prepared the necessary documents to give that person the power and authority he or she will need to deal with your creditors, medical providers, and so on? Does someone expect you to take care of their affairs if they become disabled or incapacitated? Do you know what you need to do to take care of their affairs? People often forget that a good estate plan also prepares for a time when you may be incapacitated, but still living.
